TOPS Permits Explained: Buying Cycads Legally in South Africa

In South Africa, cycads are protected under the Threatened or Protected Species (TOPS) Regulations of the National Environmental Management: Biodiversity Act (NEMBA). This means that buying, selling, or possessing certain cycad species without the correct permits is a criminal offence.

Why Are Cycads Protected?

South Africa's Encephalartos species are among the most threatened plants on Earth. Illegal poaching from the wild — driven largely by collector demand — has pushed many species to the brink of extinction. TOPS regulations exist to ensure that trade is sustainable and that plants are legally sourced.

What Is a TOPS Permit?

A TOPS permit is an official document issued by a provincial nature conservation authority (such as Gauteng Department of Agriculture and Rural Development). It records:

  • The species of cycad
  • The number of plants
  • The seller and buyer details
  • The permit number and issuing authority

This creates a paper trail that proves the plant was legally sourced and legitimately transferred.

What You Should Receive When Buying

When you purchase a cycad from a reputable nursery, you should receive:

  • A valid TOPS permit for the specific plant(s)
  • A receipt of sale
  • Guidance on how to register the plant in your own name if required
